I am moving 28 miles away with my 7 year old son and my ex (of 5 years) is trying to stop us. can he?

It takes approx 40 mins to get to our new place but, my ex is telling our son that he is not going but, staying with him. Im currently in rented accomadation but, the new place is a secure home for us. Can he do this?
